Selling an Indian property from overseas: prepare the handover

Organise professional advice, transaction records and connected-home access before agreeing a sale.

Have advisers determine your applicable residential status, withholding obligations, transaction documentation and remittance route. The treatment of a non-resident seller must not be inferred from a resident-seller example. Ask for a transaction-specific calculation and the current procedure before agreeing the payment schedule.

Make the sale inventory explicit

List the fixtures, automation equipment, remotes and warranties included in the agreement. Record which subscriptions are transferable and which require a new account. Agree how saved camera footage, access permissions and personal data will be handled before possession changes.

Close access as carefully as the paperwork

Arrange a demonstration for the buyer and a controlled transfer of owner accounts. Revoke old caretaker and installer access when appropriate, following manufacturer instructions and the sale agreement. Keep transaction records with your advisers. Nexoforma provides preparation guidance; it does not arrange remittance, calculate tax, hold sale proceeds or represent either party.

Current information to check

From April 2026, the new Income-tax Act introduces the tax-year framework described by the department. Historical section numbers and forms may relate to earlier periods; confirm the applicable procedure with a chartered accountant.
