Buying an Indian property as an NRI: a planning checklist

Separate legal and financial due diligence from the condition and smart-home readiness of a property.

Confirm eligibility before paying a deposit

Ask a property lawyer and your authorised-dealer bank to confirm the rules for your residency status, citizenship, property category and payment route. RBI guidance distinguishes property categories and transaction circumstances. Do not assume permission for a residential apartment applies to agricultural land, a farmhouse or plantation property.

Check the property independently

Have qualified advisers review title, encumbrances, approvals, seller authority and applicable registration records. For a registered project, verify the exact project and phase with the relevant state RERA authority. A registration number, virtual tour or automation package does not replace legal and physical due diligence.

Inspect the connected systems too

Ask which installed devices, licences and subscriptions are included in the sale. Demonstrate their operation and identify who owns the accounts. Budget separately for remedial electrical work, network changes and equipment that cannot be supported locally. Nexoforma does not list verified properties, broker purchases or provide title certification.

Current information to check

The Income Tax Department says the new Act applies to tax years beginning on 1 April 2026. Ask your adviser to use the rules and forms applicable to the transaction date instead of reusing an older online checklist.
